Privacy Notice
Burghmuir Limited · Updated 3 November 2026
This notice explains how Burghmuir Limited handles personal information for enquiries, photography and virtual-tour services, and this website.
Cookie Policy and choices ↗1. Who we are
Burghmuir Limited is the data controller for personal information processed in connection with our photography, property marketing, virtual tour and Expo360 services, and our website at https://burghmuir.com. Contact: mail@burghmuir.com; 128 Burghmuir Road, Perth PH1 1JF, United Kingdom.
2. Information we collect
We may collect names, business and contact details, correspondence, enquiries, quotation and booking information, project instructions, billing and transaction records, and technical information about use of our websites. Photography, video, floorplans and virtual tours may include identifiable individuals or information relating to a property or premises. We may receive information directly from customers, property owners, event organisers, their representatives and relevant service providers.
3. Why we use information and our lawful bases
We use contact and enquiry details to respond and provide quotations (legitimate interests, or steps requested before entering a contract); customer and project details to deliver agreed services (contract where applicable, or legitimate interests for business contacts); invoicing and accounting information to meet legal obligations and administer our business; and correspondence and project records to manage disputes and legal claims (legitimate interests and, where applicable, legal obligations). We use website security logs to protect services (legitimate interests). Where we use optional analytics or other consent-based tracking, the relevant processing is based on consent unless another lawful basis is properly identified and disclosed.
4. Photography and virtual tour content
Our work may include photographs, video and virtual exhibitions commissioned by clients. Clients should ensure that they have appropriate authority to arrange photography, access premises and provide relevant information. Where identifiable people appear, the applicable privacy arrangements and lawful basis depend on the circumstances and the respective responsibilities of Burghmuir and the commissioning client. Some clients may act as independent controllers or instruct us as a processor; the relevant contract should identify these roles. Content supplied for publication may be visible to the public and to the commissioning client’s audience.
5. Marketing communications
We may contact existing or prospective business customers about relevant services where permitted by UK data protection law and the Privacy and Electronic Communications Regulations. Where consent is required, we will obtain it. You may opt out of direct marketing at any time by emailing mail@burghmuir.com or using an unsubscribe mechanism where provided. We do not assume that all business email addresses are exempt from marketing rules.
6. Website analytics and cookies
Our websites may use cookies, browser storage and similar technologies for site functionality, preferences and analytics. Optional analytics will be governed by the controls implemented on the relevant website. See our Cookie Policy at https://burghmuir.com/cookie-policy.html. Where enabled, optional Google Analytics 4 measures visits, page use and interactions, browser and device information and approximate location, on the basis of consent. You can withdraw consent through the site’s Cookie settings control. Separately hosted tours and exhibitions may have their own privacy settings. See our Cookie Policy for storage details and choices.
7. Who receives information
Information may be shared, as necessary, with website and cloud hosting providers, IT support, payment and accounting providers, professional advisers, insurers, and clients or suppliers involved in delivering projects. We may disclose information where required by law. Third parties processing information for us must be subject to appropriate safeguards and agreements where required. Our website and hosted content use Amazon Web Services (including S3 and CloudFront). Google receives analytics information where that service is enabled and you consent. You can ask us for further information about relevant service providers.
8. International transfers
Some technology providers may process personal data outside the UK. Where restricted transfers occur, we will use an applicable UK adequacy regulation, the UK International Data Transfer Agreement, the UK Addendum to approved standard contractual clauses, or another lawful mechanism as appropriate. We do not rely on the former EU-US Privacy Shield. Contact us for information about the safeguards applicable to your information and how to obtain a copy where available.
9. Retention and security
We retain information only for as long as reasonably necessary for the purpose collected, including contractual, accounting, tax and legal requirements. Financial records are generally retained for relevant statutory periods; project files, images and correspondence may require different schedules depending on client contracts and legal obligations. We use appropriate technical and organisational security measures and limit access where practicable. For enquiries and project correspondence, we assess retention by whether the enquiry remains active, our ongoing client relationship and any need to establish or defend legal claims. Images and project files may be retained as a professional archive and to document authorship and licensing; retention is reviewed against those purposes, client arrangements and applicable rights. Security logs are retained for operational security and incident investigation. Contact us for information about the retention criteria relevant to your project.
10. Your rights
Subject to applicable conditions and exemptions, you may request access, correction, erasure, restriction, portability, or object to certain processing. You may withdraw consent where processing is based on consent. Contact mail@burghmuir.com. We normally respond within one month, subject to lawful extensions. If you have a concern, please contact us at mail@burghmuir.com so we can investigate and respond. You also have the right to complain to the Information Commissioner’s Office.
11. Children and third-party links
Our website is intended to present our business services. Some commissioned photography may involve children, for example at a nursery; relevant privacy arrangements must be considered for the individual project. Links to third-party websites are governed by those organisations’ notices.
12. Providing information
We need relevant contact, booking and project information to respond to enquiries and deliver services. If necessary information is not provided, we may be unable to quote or carry out the work. Optional analytics is not required to browse this website.
13. Changes
We may update this notice when our services, suppliers or legal obligations change. The date above identifies this version.
